Our practice area is Property Law.
To obtain construction permission for your property, you can apply at the Local Administrative Organization or the Municipality Office in the jurisdiction where your land is located. The Structure Plans or drawing plan must be certified by a licensed architect or engineer and submitted together with the application form. The approved building permit will outline the specific specifications for your construction project.
Foreigners who have legally entered Thailand may purchase freehold condominium units in specific projects located in municipal jurisdictions like Bangkok, Pattaya, and Phuket, provided the project is built on land with total area of the land on which a condominium is situated, when combined with common area use or benefit of all co-owners, shall not exceed 5 rais (approximately 2 acres). However, foreign ownership of condominium units within a project is limited to 49% of the total condominium building registered with competent officers. Additional restrictions may apply. Foreign owners of freehold condominium units can transfer their property ownership to other foreigners.
While foreigners cannot directly own land in Thailand, there are alternative legal options for them to acquire property rights.
Set up a Thai Limited Company: Foreigners can purchase land through a Thai Limited Company with at least 51% Thai ownership. This option requires ongoing business operations and can be costly.
Leasehold: Foreigners can lease land for long periods (not exceed 30 years), but the lease terminates upon the lessee’s death or breach of contract.
BOI Promotion: Foreign companies with significant investments benefitting Thailand can acquire land for promoted businesses.
